Terms and conditions
Please read these before you claim a brick. This draft is not yet in force.
Last updated: DRAFT, not yet in force
1. What a digital brick is
A brick is a symbolic digital collectible: a unique, permanent number between 1 and 1,000,000, a place in the wall shown on this website, and the display name you choose. It is not a physical object and nothing is shipped.
2. Current benefits
At this time a brick includes only what is described in clause 1. [TO DEFINE BEFORE LAUNCH: list any additional benefit only once it is confirmed and can be delivered.] No future benefit is promised.
3. Not an investment
A brick is not an investment, security, share or financial product. It gives no ownership, equity, voting rights, profit share or financial return, and is not expected to increase in value.
4. Purchase limit
Each customer may acquire a maximum of 5 bricks in total, across all orders. Bricks received as a gift or through any future marketplace count towards this limit. A customer account is required to buy.
To prevent the limit being bypassed, accounts are treated as one customer when they share a verified email address (ignoring dots and +tags in Gmail addresses) or a payment card (identified by card brand, first 6 and last 4 digits and expiry). Matching phone numbers or billing addresses are reviewed by us but do not block a purchase on their own.
A checkout that would exceed the limit is refused with the message “You can purchase a maximum of 5 bricks per customer.” If an order over the limit is paid anyway, no bricks are assigned and the order is cancelled and refunded in full.
5. Display names and moderation
Names may contain letters, numbers and simple punctuation, up to 20 characters. Names with links, offensive words, or that impersonate another person or brand are held for review and may be hidden or changed. Anyone can report a name through the Contact page.
6. Resale
Resale of bricks through this website is not available. [TO DEFINE BEFORE ANY MARKETPLACE OPENS: rules, eligibility, legal review.] We do not guarantee that a brick can be resold.
7. Ownership transfers
Bricks are linked to the customer account that holds them. You can give a brick to another person for free with a private gift link from My Bricks; the recipient must log in to claim it within 14 days, the brick keeps its number, and it counts towards the recipient's purchase limit. Gifts cannot be claimed by someone who already has 5 bricks.
8. Platform fees
The price of a brick is shown before checkout and includes any applicable taxes or is shown with them at checkout. There are no other fees at this time. [TO DEFINE: any resale commission, if a marketplace opens.]
9. Refunds and cancellations
[TO DEFINE BEFORE LAUNCH: refund period and conditions, and the EU right of withdrawal for digital content.] If a brick is refunded or an order is cancelled, the brick is removed from you and its number is retired; it is not assigned to anyone else. A refund does not restore your purchase allowance (see "Purchase limit"). Unpaid or failed payments never receive a brick number.
10. If the wall never reaches 1,000,000
[TO DEFINE BEFORE LAUNCH: how long the wall stays online, any deadline, and what happens to purchases.]
11. If the platform closes
[TO DEFINE BEFORE LAUNCH: notice period, whether the wall remains available as an archive, and how owners will be informed.]
12. Privacy
We store your brick numbers, display name, country and purchase date. To enforce the purchase limit we also store your Shopify customer number and salted one-way hashes of your email address, phone number, billing address and a card fingerprint (card brand, first 6 and last 4 digits, expiry). Hashes cannot be turned back into your details. Full card numbers stay with Shopify and its payment providers; we never receive them. Your name is shown publicly only if you choose so at checkout. See our Privacy Policy for details. [CHECK BEFORE LAUNCH: list this processing and its legal basis (fraud prevention / enforcing these terms) in your Privacy Policy, and how long the hashes are kept.]
